Gift Acceptance Policies and Procedures
Overview
The Gift Acceptance Policy and Procedure guidelines have been established to ensure:
- consistent, ethical and equitable relations with all donors and sponsors
- compliance with federal and provincial laws and regulations
- rigorous administrative, legal and accounting practices
Ongiara College of Acupuncture and Moxibustion and Ongiara Foundation may accept or decline any gift. The final decision to accept or decline a gift rests with the respective Board Directors. The negotiation and development of terms and conditions relating to any gift is conducted initially by the Treasurer of the Board of Directors, with appropriate input from the respective Advisory Board and/or college administration.
Canada Customs and Revenue Agency (CCRA) and the United States of America Internal Revenue Service (IRS)
All policies and procedures described are designed to comply with current laws and regulations. In cases of disparity, federal, state and provincial laws as well as CCRA and IRS regulations will supersede these policies and procedures.
Charitable Registration Number for Canada
Ongiara College of Acupuncture and Moxibustion, a not-for-profit Ontario corporation, has applied for charity registration under the Canada Customs and Revenue Agency (CCRA).
Charitable Donations Number for the United States
Ongiara Foundation, a non-profit corporation, has a pending federal tax exemption application with the United States of America’s Internal Revenue Service (IRS). Any contribution made prior to the granting of federal tax exemption shall be deductible if given after October 4th 2007.
Scope of Policies
These policies and procedures are established to govern the acceptance of all gifts made to Ongiara College or Ongiara Foundation, whether such gifts are inter vivos (during the donor’s lifetime) or testamentary (trusts and estates).
Role of Legal & Professional Counsel
Before any major or planned gift is transferred, a donor is strongly encouraged to discuss the proposed gift with an independent legal counselor, insurance agent and/or financial advisor (as appropriate to the nature of the gift). It is the responsibility of all Ongiara representatives to recommend to the donor that he/she seek such independent counsel. This will serve to eliminate any perception of undue influence by Ongiara representatives and will help to ensure that the donor does receive independent counsel. Please note that the donor is responsible for any expenditure incurred for an associated appraisal cost and/or when seeking independent advice.
Ethics
Ongiara has an ethical responsibility to every donor. All staff and volunteer representatives acting on behalf of Ongiara will conduct themselves in accordance with accepted professional standards of accuracy, truth and integrity. The Code of Ethical Principles and Standards set out by the Association of Fundraising Professionals (AFP) will serve as fundraising guidelines for Ongiara College and Ongiara Foundation.
Conflict of Interest
Donor interest and well-being must take priority in any gift negotiation.
Gift Categories Requiring Prior Approval
Gifts-in-kind must be reviewed and approved in advance by the Treasurer of the Board of Directors. All relevant information about the gift must be documented, including a copy of any appraisal.
Gift Refusal
When an offer of a charitable gift is judged to be contrary to Ongiara’s best interest, the Chair of the Board of Directors may request that the terms be revised or decline the offer. The final decision to accept or decline any offer rests with the Board of Directors.
Some reasons for the refusal of a gift would be that it:
- has terms and conditions that are too narrowly restricted
- will not be able to be utilized or liquidated within a reasonable time frame
- has an attached liability that could create an undesired financial burden on Ongiara
- jeopardizes the tax-exempt status of Ongiara College or Ongiara Foundation
- violates any federal, state and/or provincial laws or regulations
Anonymous Gifts
When a donor wishes to remain anonymous, Ongiara will ensure that such wishes are respected.
